Guildford Magistrates Court

Defendant: Guildford Borough Council

Matter of complaint:


I Mark Guy Rostron being a hackney carriage driver, and a proprietor of Guildford Hackney Carriage licence plate number 68 registration number YT63UVU licenced by Guildford Borough Council give notice as follows:


Under the terms of the Local Government Miscellaneous Provisions Act 1976 s47, I am aggrieved by the purported condition that the vehicle be liveried in a green plastic wrap which is purported by the Council to be imposed, and purportedly attached to my hackney carriage vehicle licence in a defective and unlawful licence dated 22nd May 2017 which did not contain the statutory notice of right of appeal required by section 300(3) of the Public Health Act 1936.


I am aggrieved as the said purported licence condition is NOT reasonably necessary.


A similar appeal by Mr Benn Simmonds is still to be decided by appeal to Court of Appeal.


And that the said Mark Guy Rostron applies to this Court for an order that Guildford Borough Council,

  1. cancels the above mentioned purported licence condition on my hackney carriage and
  2. cancels its unlawful suspension notice falsely issued on grounds which are not to do with the fitness or safety of the vehicle.

The complaint of Mark Guy Rostron who states that the Defendant is responsible for the matter of complaint of which particulars are given above.
