Letter of Claim (pursuant to Annex A of Pre-Action Protocol for Judicial Review under CPR Part 54)


The Proposed Claimant


The Proposed Claimant is Mr Mark Guy Rostron.


The Details of the Matters Being Challenged and Reference Details


The decision of the Council, by its Licensing Officer Mark Adams, to suspend by section 68 of the Local Government (Miscellaneous Provisions) Act 1976 the hackney carriage vehicle license in Guildford, number 68 for vehicle registration number YT63UVU.


Summary of the Proposed Claimant’s Case


I am of the view that the decision to suspend was flawed and is susceptible to judicial review for the reasons set out in the attached draft document:


Action Expected from the Defendant and the Date of Reply


The Council is invited to confirm in writing that it shall:


  1. Cancel the suspension of the said hackney carriage vehicle license
  2. Return the vehicle hackney carriage license plate.
  3. Compensate me for the extra cost and loss of earnings resulting from the suspension.

Should it fail to do so within 14 days, and continue the suspension or proceed to revoke the said license, I will prepare an urgent application for judicial review of those decisions, and to seek an interim injunction to restrain the Council from imposing the suspension or revocation.
